Can an agent get you admitted? What Chinese rules say about outside recruiters

No. Admission is decided by the university, not by anyone acting for you, and the rules tell the university that it may not hand that work to someone else in the first place. Order No. 42, Article 12 states that the admission of international students is decided by the school, and that a school may not admit an applicant who does not meet its admission conditions. Section 2.7 of the Quality Standards for the Higher Education of International Students in China (Trial) states that a university must not entrust its international-student recruitment and admission work to any outside agency or individual.

What the rules say about outside services

Section 2.7 does two things. It sets the prohibition: a university's international-student recruitment and admission work must strictly observe the relevant national regulations and must not be entrusted to any outside agency or individual to act as its agent. It then covers the case where a university does bring in outside help for admissions information and consultation. In that case it must act on the principles of prudence, standardisation, openness and transparency, and must strictly perform its regulatory responsibility in accordance with the relevant national regulations or norms, so as to safeguard educational order and the lawful rights and interests of international students.

Section 2 sets the surrounding duty. A university should publish admissions-related information truthfully, accurately and comprehensively, should act in good faith in admissions publicity and consultation, and should give foreign students sufficient information support for their study choices. Admission is to follow standardised, open and fair principles, with sound management systems and reasonable examination or assessment methods, selecting international students who have academic ability and development potential, and the university bears the social responsibility of maintaining educational fairness.

Who decides admission

Order No. 42, Article 12 gives the sequence. A university examines the entrance qualifications and the proof of financial guarantee of the foreign citizen who has applied, and administers an examination or assessment. The admission of the international student is then decided by the school, and the school may not admit an applicant who does not meet the admission conditions.

Order No. 42 was signed on 20 March 2017 and came into force on 1 July 2017 (Article 48), and Chapters 2 to 5 apply to higher education institutions (Article 2).

The admission conditions themselves, and the programme, dates, length of study, fees and language evidence a given school asks for, are the university's own decisions, published in its own admissions brochure. The provisions quoted on this page do not cover the content of any particular brochure.

What happens if a university gets this wrong

Order No. 42, Article 44 sets the consequence. Where a higher education institution, in recruiting and educating international students, commits the listed acts, the competent education administrative department shall order it to rectify, pursue legal liability under the provisions of the Education Law of the People's Republic of China, and may restrict its recruitment of international students.

Two of the listed grounds concern admission directly: item 1, recruiting in violation of national regulations and the school's own admission regulations; and item 2, profiteering in the admission process. The article lists further grounds in items 3 to 6.

So what can an outside helper lawfully do?

The provisions above are addressed to universities, and they describe the boundary from the university's side. The practical reading of them is short: an outside party may inform, the university decides. That reading is this site's, not a quotation from the official texts.

Everything that belongs to the university's side of that line stays there. No outside party can decide your admission, apply the university's admission conditions on its behalf, or change them. What can sit on the other side is information work: explaining published requirements in a language you read, helping you assemble documents the university has asked for, and keeping you to the dates the university has published.

A planning suggestion, not a requirement: build your file around the university's own admissions brochure and its official admissions office, and verify there anything a third party tells you about conditions, dates or results. A claim that someone can secure admission, or arrange admission for someone who does not meet the conditions, describes something section 2.7 and Article 12 do not allow on the university's side, and Article 44 item 2 lists profiteering in the admission process among the grounds for correction.
