Extending a study residence permit when your degree runs longer than planned

Your degree may need an extra semester. To keep studying lawfully, extend your residence permit before it expires. Under Article 32 of the Exit and Entry Administration Law, you file the application within 30 days before the permit expires at the exit/entry administration of the public security organ for your place of residence; if your reasons for extension are appropriate and sufficient, the extension is granted.

When and where to file

A foreigner residing in China who applies for an extension of the residence duration shall, within 30 days prior to the expiry of the validity period on the residence permit, file the application with the exit/entry administration of the public security organ under the local people's government at or above the county level, and submit the relevant information of the specific application matter as required (Exit and Entry Administration Law, Article 32).

The National Immigration Administration's English service guide states the same window in its own words: for a foreigner residing in China applying for an extension of the residence period, the application shall be submitted to the exit/entry department of the public security organ at or above the county level in the place of residence 30 days before the expiration of the residence permit's validity period (Service Guide on residence permits for foreigners, section "Application for Extension or Change of Residence Permit").

What you need to submit

Regulations Article 17 sets the general documents for an extension, change or reissuance of a residence permit: fill out an application form and submit your passport or other international travel document, qualified photos, and material relating to the purpose of the application (Regulations, Article 17).

For a study permit, the National Immigration Administration's Chinese-language residence permit guide is specific. A person who entered with an X1 visa shall submit a letter from the school stating the period of study and the admission or matriculation proof; if the relevant information has been registered through the national studying-in-China management information system, the paper materials may be exempted. A person who entered with another visa type shall also submit certification issued by the competent authority (National Immigration Administration residence permit guide, section 6.2, item 2, "study category"). A residence permit consistent with the school-stated study period may be issued.

Because the changed element is the new end date, the university's letter stating the new period of study is the core document for the extension.

The receipt and the decision

Where the application for extension meets the acceptance provisions, the exit/entry administration authority of the public security organ shall issue a receipt of acceptance valid for a period not exceeding 15 days, and make a decision on whether to issue the visa within the validity period of that receipt (Regulations, Article 18).

If the procedures followed or the material submitted do not conform to the relevant provisions, the authority shall, in a one-off manner, notify you of the procedures to follow and the material to be supplemented and corrected (Regulations, Article 18).

While your passport or other international travel document is retained for processing, you may reside in China legally on the strength of the receipt of acceptance (Regulations, Article 18).

If the extension is refused

If, upon examination, the reasons for extension are not appropriate and sufficient and the extension is denied, you shall leave China on the expiry of the validity period stated in your residence permit (Exit and Entry Administration Law, Article 32). The National Immigration Administration guide states the same outcome: in case of a denial on extension of the stay duration, the foreigner shall leave before the expiry of the residence certificate (Service Guide on residence permits for foreigners, section "Application for Extension or Change of Residence Permit").

A short planning note (suggestion)

Suggestion: ask your university for the letter with the new study end date before the 30-day window opens, so you are ready to file within it. This is planning advice, not a rule in the documents.

Can I stay in China while the extension is being processed?

Yes. While your passport or other international travel document is retained for processing the application, you may reside in China legally on the strength of the receipt of acceptance (Regulations, Article 18).
